AJNALENS PRODUCT (‘THE PRODUCT) IS MANUFACTURED BY DIMENSION NXG PVT. LTD. (HEREINAFTER DIMENSION NXG PVT LTD AND AJNALENS COLLECTIVELY REFERRED AS ‘THE COMPANY’). THE COMPANY HERE IN BELOW SETS OUT THE TERMS OF THE ONE (1) YEAR LIMITED WARRANTY (“WARRANTY”).
IF YOU ARE USING THE PRODUCT THEN IT IS CONFIRMED THAT YOU READ THE TERMS OF THE WARRANTY AND AGREED TO THE SAME UNCONDITIONALLY AS WELL AS WITHOUT ANY DOUBT WHATSOEVER. IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT IN ACCORDANCE WITH THE COMPANY’S RETURN POLICY.
I.Definitions
- “Defect” means any verifiable and reproducible failure of the Product to materially conform to the Specifications that is validated by the Company.
- “Product” means any Company-branded hardware product that is purchased by You directly from the Company or through an authorized representative.
- You” or “Your” means either the single individual or legal entity that orders from the Company a Product.Specifications means the applicable Company-published technical Product specifications.
II. Scope of Warranty
- The Company warrants the Product and associated accessories packed combinedly in the original packaging for any defects in materials and otherwise when used in line with the Company’s published manual (indicating guidelines to use the Product) for a period of ONE (1) YEAR from the date of original purchase from the Company or authorised person ("Warranty Period"). The Company’s manual includes, but not limited to, information pertaining to technical specifications, user manuals and service communications.
III. Exclusion of Warranty
- The Company excludes any hardware products or any software, which is/are not explicitly mentioned as the Product of the Company, sold jointly and/or standalone even with the Product from the aforesaid term of Warranty. Software distributed by the Company in any manner whatsoever is not covered by this Warranty.
- In the event of warranties provided by third parties such as, but not limited to, Manufacturers and/or, suppliers and/or publishers You must contact the relevant third party for any claim and/or dispute and/or issue. These warranty provisions do not apply to: (i) any Product repaired by parties other than the Company, or to any parts used for said repair purposes, even if the third party is authorized to purchase said parts from the Company for the purpose of providing such repairs; (ii) any Product for which non-Company supplied components or replacement parts are added by you or some other third party who is not specifically authorized by the Company to use said components or parts; or (iii) any hardware products not actually manufactured or assembled by the Company, even if said third-party hardware products were sold to you by the Company.
- The Company is not responsible for any damage to the Product occurred due to failing to follow the instructions/guidelines mentioned in the Company’s Manual.
- The Company hereby disclaim any guarantee in respect of flawless working of the Product. It does not warrant that the operation of the product will be uninterrupted or error-free.
- The Company reserves its rights to limit and/or discontinue and/or forbid the terms of the Warranty mentioned above at any place, city, country without any notice to you.
- This Warranty exclude consumable parts, such as batteries or protective coatings, cosmetic damage, such as, but not limited to scratches, dents and broken plastic on ports unless error arises due to flaw in the in materials or designing of the Product. Failure caused by any third-party software installed by You or any third-party hardware is integrated with the Product by You. Further, damaged caused by normal wear and tear or otherwise due to the normal aging of the Product.
- This Warranty exclude damage caused by accident, accidental falling/breakage, abuse, misuse, fire, liquid contact, earthquake or other external cause, by using the Product not in line with the Product manual, repair or service by any third party who is not Authorized by the Company.
- This Warranty will be forbidden if the Product has been modified to alter functionality or capability without the written permission of the Company, if any serial number has been removed or defaced from the Product
- This Warranty will be forbidden if the Product is stolen or unauthorized access is detected by the Company.
- To the extent allowed by applicable law, the Limited Warranty is only made to You, the purchaser of the Product, and there are no Third-Party beneficiaries of the Limited Warranty. Except as required by law, this Limited Warranty is not intended for and does not apply to anyone else, including anyone to whom You make any transfer Your Product.
- If You purchased an extended product maintenance and/or service contract from the Company, then such extended maintenance service will be provided to You under the terms of such Extended Maintenance Contract, which is in addition to and not the same as the Limited Warranty hereunder. Please refer to specific maintenance contract for details on how to obtain service for Your Product.
IV. User’s Do’s and Don’ts
- The User is the person who purchased the Product from the Company or authorised person.
- The User must not try to open the Product in any event, if the User does it then in such an event the terms of Warranty will not be applicable.
- The User must keep backup of data, periodically, stored and/or continuously get stored by usage in the Product to ensure safety of the data in the event of operational failure of the Product and/or the time of depositing the Product for Warranty Service, as in both the aforesaid events the data will be deleted and/or removed from the Product.
- The User must keep original invoice to prove the Product is under Warranty Period to the Company’s representatives and ensure to provide correct details enabling the Company’s representative/s to help in finding the best possible solution to your problem/query/issue.
- The User shall not reverse engineer, rebuild, repair, copy, tamper, open, disassemble Product.
- The Company shall provide the Product after warranty service in original mode i.e. configured with Factory settings alike a new Product. The Company will ensure all updates in the system software are provided. The User is responsible for installing any other third-party software, data at his/her own risk.
V. Responsibilities of the Company in Warranty Period
- Any product submitted to the Company or its Authorized personnel within the Warranty Period and the Warranty Claim is found to be defective in materials or workmanship to satisfaction of the Company or its Authorized personnel then the Company may, at its sole option, use reasonable efforts to repair or replace the Product, provided that the Product has been used within normal operating conditions. In the event of repair or replacement the Company may use new or equivalent-to-new components or hardware with equivalent fit, form, and function while ensuring best of performance of the Product. Any Hardware without a validated defect will be returned to YOU at your expense.
- User is responsible for shipping the suspect Product, in either its original packaging or packaging affording a reasonably equivalent degree of protection, to Company’s designated location. User will pay the freight and any corresponding customs, taxes, duties, or other fees related to the return of the suspect Product to Company’s designated location.
- If it is determined that the problem is not covered under this warranty, the Company will notify You and inform You of service alternatives that are available to You on a fee basis.
- The Company may require you to replace previously authorised third party parts installed with the Product or the part of the Product. Such replacement must be done under the supervision of representative of the Company or its Authorized personnel and are covered within the original Warranty Period.
- The Company owns the Product or any part there of which is replaced with new or equivalent-to-new Product or any part thereof.
- The Company shall provide self-explanatory troubleshooting information on their website to enable user to correct the defect in the Product on their own.
- The Company shall facilitate registration for Warranty service via telephonically, email, post and other communication medium. It is important to procure acknowledgment of your request and opt for various options, such as but not limited to, in-person submission of the Product, Ship the faulty Product to Authorized address of the Company, rectify the fault on your own under supervision of Authorized representative of the Company remotely, to deliver the faulty Product to the Company.
- The Company may charge for contacting their Authorized personnel for Warranty service.
VI. LIMITATION OF LIABILITY
- EXCEPT AS EXPRESSLY SET FORTH HEREIN, IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PRODUCTS IS PROVIDED ON AN “AS IS”AND “AS AVAILABLE” BASIS AND THE COMPANY AND ITS AUTHORIZED REPRESENTATIVES DISCLAIM ALL WARRANTIES RELATING TO THE PRODUCTS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT AN IMPLIED WARRANTY CANNOT BE EXCLUDED, SUCH WARRANTY IS LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIOD.
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF HEALTH; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE PRODUCT OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED ON THE PRODUCT.
- THE COMPANY DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR REPLACE THE PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED IN THE PRODUCT.
- IN ANY EVENT OF DISPUTE/DISAGREEMENT/CLAIM THE COMPANY IS LIABLE TO PAY AN AMOUNT OF EQUAL TO A MAXIMUM OF 50% PURCHASE COST OF THE PRODUCT.
VII. GENERAL
- No company’s reseller, agent, or employee is authorized to make any modification, extension, or addition to this Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
- This Warranty is governed by and construed under the laws of India, without reference to its conflict of laws principles.
- The Company or its successor in title is the warrantor under this Warranty.
- This Limited Warranty is Company’s sole liability and Your sole and exclusive remedy for any failure of the Product to operate in accordance with the Specifications.
- The terms and conditions under this Limited Warranty supersede any prior agreements or representations including, without limitation, any representations made by Company representatives or in any Company sales literature that may have been made in connection with the purchase of the Product. No change to the conditions of this Limited Warranty shall be valid unless it is made in writing and signed by an authorized representative of the Company.
